It also alleges that he failed to give Mrs Snelson 'any adequate or effective warning of the dangerous nature of the makeshift ramp'.
"We are led to believe that Mr Fountain has since passed away. Mrs Snelson has not been able to return to work, so has never been informed of that fact by Stockport PCT.
He added: "My father was a real gentleman and had been married for 51 years. All the condolence cards said what a real gentleman he was. Everyone liked him and he was very popular Air Max 90 Anthracite Black Wolf Grey guy. He was very modest but had achieved a lot in his life."
Mr Fountain, the letter adds, also failed to place a barrier around the ramp and therefore 'failed to discharge the common duty of care'. It also claims that he 'failed to heed previous complaints' about the ramp. But Graeme said no complaints had been received. He has vowed to visit the solicitors' offices in person after the letter said he had 21 days to respond to the action.

Graeme made the ramp from a garden gate to lie against the doorstep and it was first used a week before his father's death.
The retired research chemist, a grandfather of five, died from cancer on June 11 aged 75 just a week after Mrs Snelson's visit of June 4.
"Both Mr Snelson and Aegis Legal send their deepest sympathy to the family for their loss. Aegis Legal would invite Mr Fountain's household insurers to contact them to discuss the matter."

"Mrs Snelson is the innocent party in this accident. She was sent to the home to care for Mr Fountain by Stockport PCT. She was invited there by his family but in doing so, his family exposed Mrs Snelson to a risk of injury.
Her solicitors, Altrincham based Aegis Legal, said the nurse was not told of Mr Fountain's death but have confirmed they are continuing with the action. The company had previously addressed a letter to the deceased alleging negligence. It was opened by Mr Fountain's grieving widow Air Max 90 1990
The letter says Mrs Snelson, from Bredbury, Stockport, fell as a result of the 'makeshift ramp' and claims Mr Fountain was at fault 'by reason of negligence and/or breach of statutory duty'.
Mrs Snelson refused to comment.
A spokesman for NHS Stockport said Mrs Snelson was employed as a 'bank nurse' and the trust had 'no influence or control' over the action. She added: "We can understand the distress this action must be causing the family."

"Mrs Snelson, who is a hard working, caring 40 year old district nurse, should not have been put in the position where she went to work to care for a patient and through the negligence of the patient's family, has sustained severe ligament damage to her ankle and foot that is currently causing her severe pain, has led her to wearing an aircast boot, the use of crutches and a course of physiotherapy.
His son, Graeme, 39, from Bramhall, Stockport, criticised the 'insensitivity' of the claim and said many other nurses used the ramp before the fall.
Mr Fountain, a father of three, is told to send inspection records, safety checks, accident book entries and housekeeping records to the firm.
"In order to gain access to the property to care for Mr Fountain, she had to walk over the ramp. This was her first visit to his home and as she stood on the ramp in order to leave, she fell and injured herself.

He said: "The nurse used the ramp to get into the house on the day without any problems. I am not sure if she had visited before because there were a whole range of district nurses who all used the ramp.
The nurse instructed solicitors more than two months later to pursue a damages claim for 'soft tissue injuries' to her ankle and foot which she says have prevented her returning to work.
"The first we heard of this action was when the letter addressed to my father dropped on my mother's doormat last week. To send this matter to my dad is just out of order but this is obviously the society we live in.
He said: "Someone is suing a deceased person for minor tissue damage to their ankle. The nurse should have thought twice about it. I am angry about how upset this has made my mother. I am angry about how the solicitors have addressed a letter to a dead person. I think it is very insensitive."

District nurse Penelope Snelson, 40, fell on a wooden wheelchair ramp at Mike Fountain's home after a routine visit. The ramp six feet long and a foot off the ground was used by Mr Fountain to access his home in Cheadle Hulme, Stockport, in the final week of his life.
"This is despite the fact that the PCT requested Mr Fountain's family to remove the shed door and the family had regularly removed it after using it for wheelchair access. She understands that Mr Fountain's own son had also fallen off it.
In a statement Aegis Legal said: "She was working for Stockport Primary Care Trust as a district nurse and had been requested to attend at the home of a Mr Fountain. The entrance to the patient's home was by way of a makeshift ramp which appeared to be an old shed door or gate to allow temporary wheelchair access.
Mrs Snelson was employed at the time as a bank nurse for Stockport Primary Care Trust.
"The nurse was on her way out at the time. There was another nurse present as well. As she was leaving she looked around to my mum and fell as she was stepping down onto the ramp.
